Terms and Conditions of Downloading Service of English Operation Manuals

This TOC is a legal agreement between you and Sony Corporation (“Sony”). This TOC covers the downloading service of English Materials in this web site. By clicking “I Agree” button below, you are deemed to agree to this TOC. If you do not agree to this TOC or if you are not in Japan, Sony does not offer this downloading service. In such event, you should not download, copy or otherwise use the English Materials.

1. Intended Customers. You acknowledge that English Materials are provided solely for the customers who bought in Japan Sony’s digital imaging products sold for Japanese market (hereinafter, such Sony’s product which you bought is referred to as “Your Sony Product”) and who are in Japan. Sony shall have no obligation to provide the services, including the explanation to the inquiry with regard to English Materials.
2. Explained Products and Japanese Materials. You acknowledge that English Materials are not provided for Your Sony Product, and English Materials are written for providing information of Sony’s similar products sold in the area other than Japan for customers who buy such Sony’s similar products in such area (“Explained Products”). Information and/or explanation (including, but not limited to, the explanation on functions of Sony’s products) provided by English Materials may be different from information and/or explanation provided by instruction materials and other documents that are contained together with (A) Your Sony Product, (B) Explained Products currently sold or (C) other Sony’s products. Further, you acknowledge that (A) contact address of Sony and/or (B) the explanation, disclaimer, note, caution and/or other information with regard to safety standard, safety requirement or other safety regulation in English Materials does not intend to provide the information for customers in Japan. You shall refer to the documents and materials contained together with Your Sony Product (“Japanese Materials”) so as to confirm the contact address of Your Sony Product and to secure your safe operation of Your Sony Product.
3. No Obligation to Offer Other Materials. Sony shall have no obligation to offer all the English Materials for all models of Sony’s products for this downloading service.
4. Modification to Materials. The information and explanation of the documents and materials included in Sony’s products will be revised, changed, modified and rectified from time to time. The English Materials shall be only for your convince to read the Japanese Materials, and you shall read Japanese Materials so as to obtain official information and explanation provided by Sony.
5. Scope of English Materials. Sony shall have no obligation to offer all of the documents or materials referred to in Explained Products for downloading services. Explained Products may include documents and/or materials (for example, summary of operating instruction or table of errata) other than English Materials.
6. Discontinuation: Explained Products may be already discontinued to manufacture, and that you may not be able to buy Explained Products due to such discontinuation of production or any other reasons.
7. Limited License. Sony grants you a royalty-free, non-transferable, non-exclusive, limited license only to use one copy of English Materials personally in Japan. Unless otherwise expressly provided herein, all copyrights of English Materials shall be reserved by Sony. The reproduction in whole or in part of English Materials shall be prohibited by copyright law of Japan and any applicable international treaties.
8. Termination by Sony. This downloading service may be terminated or changed without prior notification at Sony's sole discretion from time to time.
9. No Warranty. You expressly acknowledge and agree that use of the English Materials is at your sole risk. THE ENGLISH MATERIALS ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, AND SONY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SONY DOES NOT WARRANT THAT THE INFORMATION CONTAINED IN THE ENGLISH MATERIALS WILL MEET YOUR REQUIREMENTS. FURTHERMORE, SONY DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE ENGLISH MATERIALS IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY SONY OR A SONY AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE ENGLISH MATERIALS PROVE INCORRECT, YOU (AND NOT SONY OR A SONY AUTHORIZED REPRESENTATIVE) ASSUME THE ENTIRE COST OF ALL NECESSARY CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
10. Limitation of Liability. SONY SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGES, DIRECT, INCIDENTAL, CONSEQUENTIAL OR OTHERWISE, FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL THEORY RELATED TO THE ENGLISH MATERIALS. SUCH DAMAGES INCLUDE, BUT ARE NOT LIMITED TO, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF USE OF THE SONY’S PRODUCT OR ANY ASSOCIATED EQUIPMENT, DOWN TIME AND USER'S TIME, EVEN IF SONY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, SONY'S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS TOC SHALL BE LIMITED TO THE ACTUAL AND DIRECT DAMAGE OF YOU AND SHALL NOT EXCEED TEN (10) JAPANESE YEN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSIVITY OR LIMITATION OF DIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU.
11. Severability. If any part of this TOC is held invalid or unenforceable, the other parts will remain valid to the extent as permissible by law.
12. Governing Law. This TOC shall be construed in accordance with the laws of Japan. YOU HEREBY WAIVE ALL RIGHTS AND/OR ENTITLEMENT TO TRIAL BY JURY IN CONNECTION WITH ANY DISPUTE ARISING OUT OF OR IN RELATION TO THIS TOC.
